General Terms and Conditions

1. Company Responsibility

Hike Time Portugal is a registered trademark owned by João Carlos Gonçalves Coutinho, dedicated to the promotion and execution of tourist animation activities. Based at Rua Amaro da Costa, 1 4770-002 Paço D'Arcos, it holds the National Registry of Tourist Animation Agents license - RNAAT nº 318/2023, issued by Turismo de Portugal.

2. Scope

Hike Time Portugal, hereinafter referred to as HTP, is a brand and a service provider in the tourism sector that may subcontract services from other companies to carry out its activities. The programs offered by HTP can be predefined or customized according to the needs of each client. All activities presented on our digital and non-digital platforms and channels are owned and commercialized under the HTP brand.

3. Client Responsibility

By participating in activities organized by HTP, the client agrees to comply with all applicable laws and regulations, including social protection and environmental norms. By registering or booking, the client assumes certain commitments to HTP:

- You have accepted the general terms and conditions, read the program for the chosen activity, and are aware of the specific conditions for participation;

- You are aware of the physical and emotional requirements involved in the chosen activity, and that it may result in extreme and unexpected situations;

- You certify that your health is suitable for the activity in question, bearing in mind that it may involve certain risks, including the difficulty of obtaining immediate medical assistance;

- If you suffer from any condition that prevents you from performing the activity, it is important to inform HTP. For your participation, HTP will request a medical certificate confirming your doctor's authorization.

4. Non-Liability Clauses

HTP is not responsible for any accidents or losses, of any magnitude, related to its activities caused or aggravated by the client, third parties, or even by guides, partners, or contracted staff, except in cases where current legislation establishes otherwise.

We reserve the right to change or cancel an activity if safety concerns or unforeseen causes arise, such as adverse weather conditions or road blockages. In cases requiring modifications, the final decision will be made exclusively by the company representative on-site.

5. Bookings, Payments, and Minimum Number of Participants

We only accept bookings in writing, which can be made through the forms available on the website or via email (geral@hiketime.pt). By making a booking this way, the client is purchasing the requested service and agreeing to the general and specific conditions of the activity. Therefore, the client commits to paying for all services provided in the booked activity.

For programs announced as events on social media (such as Facebook), if the description does not contain specific conditions, payment will be made at the activity location before starting. If payment is made in advance and the client cancels the booking 72 hours in advance, HTP will refund the full amount, except in cases of commitments already made with HTP partners.

For all other activities and programs:

- Upon booking, 30% of the total activity value will be charged immediately, regardless of the date chosen for its realization;

- The remaining balance must be paid up to 20 days before the start of the activity;

- If the client cancels up to 20 days before the start of the activity, HTP will refund the full amount paid for the booking. If the cancellation occurs between 15 and 20 days before the start, HTP will refund 50% of the amount received. If the cancellation happens less than 15 days before the start, no refund will be issued by HTP. Exceptions may be made for services provided in the Azores or Madeira archipelagos and abroad;

- HTP reserves the right to cancel the activity at least 20 days in advance if the minimum number of participants is not reached. In case of cancellation, we will notify the client and refund the full amount received;

- In case of activity cancellation due to weather conditions, a new booking will be offered, always depending on the weather conditions of the day in question.

Advance payment for the activity can be made by bank transfer to the IBAN provided in the event or HTP written proposal, and will be confirmed once we receive proof by email (geral@hiketime.pt). If desired, we can provide a receipt with a tax identification number, provided it is requested at the time of payment. This document will be sent later by email, as per the client's indication.

6. Custom Experiences, Individual or Group Experiences

Except for scheduled events promoted on social media, all activities and experiences must be planned in advance, and the price presented depends on factors such as our team's availability, number of participants, chosen location, duration of the activity, services provided by partner companies, etc.

7. Insurance

HTP maintains all insurance policies required by law and Turismo de Portugal.

8. Transport

We provide our clients with accurate information about the departure and arrival points of each event/activity/experience. Transport or transfers are not included unless specifically mentioned. Previously quoted activities may or may not include transport or transfers depending on the client's request.

9. Schedules

The duration of activities is only an estimate and can be affected by factors beyond our control. We expect all participants to be at the defined departure point for each program and activity within a maximum limit of 15 minutes. If the client does not show up for the contracted activity, no refund will be issued by HTP.

10. Difficulty Levels

To help the client choose an experience suited to their physical level and comfort, in a fun and pleasant way, alone or in a group, we always provide a scale with the difficulty level of the activity, along with the maximum technical information available. This level can be affected by certain weather conditions or changes in terrain.

Before participating, it is important to consider whether your physical condition is compatible with the difficulty level indicated in the chosen program, according to the descriptions provided.

We classify activities into five levels of difficulty based on distance, duration, slope, obstacles, and surface type:

- For everyone – As the name suggests, this activity is intended for everyone, with short routes and moderate duration, featuring regular terrain without slopes and requiring low-intensity physical effort;

- Easy – Activity with slightly longer distances and duration, but easy to perform, covering paths with some elevation changes and low physical intensity;

- Moderate – Moderate activity with significant distances and durations, performed on trails with irregular surfaces and slopes, requiring good physical shape;

- Difficult – Physical activity that requires long distances or duration, on terrain with irregularities and steep climbs, requiring adequate physical condition and regular exercise habits;

- Very Difficult – Physical activity of long distances or durations, performed on irregular terrain with significant obstacles and slopes at different stages of the journey, requiring high fitness and regular exercise habits.

HTP is not responsible for any physical damage suffered by participants caused by a wrong choice of activity or equipment.

11. Protected Content

Everything published by HTP and all content on the HTP website, as well as content on all digital channels, platforms, social networks, and blogs used by HTP, is protected by copyright and cannot be used without prior written authorization from HTP. Copying, altering, distributing, transmitting, displaying, reproducing, publishing, transferring, or selling any information, products, or services obtained through the channels used by HTP is prohibited.

12. Materials Collected During HTP Activities

All photos, videos, and testimonials obtained during activities carried out by HTP may be used for promotion and marketing purposes of our services, unless the client's opposition is expressly stated in writing.

13. Privacy Policy

For HTP, the privacy and security of all personal data is a serious matter. To prevent unauthorized access to data, we have implemented strict security procedures regarding the storage and disclosure of all information shared with us by our clients and prospects.

Our websites and communication are for a general audience and do not offer services aimed at children unaccompanied by their guardians. If we learn that an individual may be a child under 13 and is sending us personal information, we will delete or destroy their information as soon as reasonably possible.

At any time, the removal or alteration of your information in our databases may be requested. If you no longer wish to be contacted or if you want to change your information, please inform us in writing of your intention (geral@hiketime.pt).

HTP procedures are in accordance with the European Union General Data Protection Regulation (GDPR) - (EU) 2016/679.

14. Dispute Resolution

In accordance with Article 18 of Law No. 144/2015 of September 8, we inform our clients/consumers that alternative dispute resolution entities are registered in the list of the Directorate-General for Consumers, available at www.consumidor.pt.

Clients/consumers are informed that we are not associated with any dispute resolution entity and, in case of a dispute, they must resort to the appropriate legal channels.

15. Complaints Book

In accordance with Articles 2, nos. 1 and 2, and 5-A, no. 6 of Decree-Law 156/2005, as amended by Decree-Law 74/2017, we inform our clients that they can submit their complaints on the platform www.livroreclamacoes.pt.
